Kindly note that by accessing and/or using the Site, you, your authorized representative and/or any entity you hereby represent (“you”, “your”) accept these Terms and the Privacy Policy and agree to be bound by them. Therefore, it is your obligation to read these Terms and the Privacy Policy carefully and make sure you agree with them before any access or use of the site.
Please be advised that by subscribing to our services, you will also be subject to the License (“License”), which shall be read together with these Terms and the Privacy Policy (together the “Agreement”). Capitalized terms used, but not defined herein, shall have the respective meanings given to them in the License.
You hereby represent and warrant that: (1) you have read the Agreement, understood the stated therein and you hereby agree to engage with the Company under its terms; (2) your age does not limit you from lawfully engaging in the Agreement and that you are not legally prohibited from entering into the Agreement; (3) you are authorized to enter into and perform the Agreement for yourself or for the entity the details of which were specified upon subscription to our services.

  1. Platform Overview
    • A marketplace for African artists, creators, and collectors.
    • Community features to explore and share cultural media.
    • A secure system for product purchases, digital content access, and delivery management.
  2. Eligibility

    You must be 18 or older (or have parental consent) to register, purchase, or sell on the platform. Sellers may be required to undergo additional verification.

  3. Accounts and Access
    • You must create an account to make purchases, post content, or manage a seller profile.
    • You are responsible for maintaining the confidentiality of your account credentials.
    • We may restrict access if there is a breach of these Terms or suspicious activity.
  4. Orders, Payments, and Refunds
    • Payments: We process payments securely through third-party payment processors. Your financial data is encrypted and never stored on our servers.
    • Refunds & Returns: Buyers have 7 days to request refunds for eligible physical products. Custom or digital products are non-refundable unless defective.
    • Disputes: Any order or delivery issues must be reported within 48 hours of receipt via support@wespeakafrica.com.
  5. Shipping & Delivery
    • Shipping Times: Delivery times vary by product and seller location. Estimated delivery windows are provided at checkout.
    • Digital Goods: For digital files or licenses, you will receive access via your account or email within minutes of successful payment.
    • Lost/Damaged Goods: Contact us within 48 hours of delivery issue. We may initiate a replacement or refund after verification.
  6. User-Generated Content

    You retain ownership of your uploaded content, but by sharing on Speak Africa, you grant us a non-exclusive, royalty-free license to use, display, and promote your content in connection with the platform. Offensive, harmful, or plagiarized content may be removed.

  7. Sellers and Creators
    • You are responsible for the accuracy of your listings, order fulfillment, and communication with buyers.
    • Sellers must comply with all applicable laws, including those regarding taxes, intellectual property, and consumer rights.
    • Speak Africa reserves the right to suspend seller accounts for violations or complaints.
  8. Prohibited Uses
    • Use Speak Africa for unlawful or fraudulent activities.
    • Infringe on third-party intellectual property rights.
    • Attempt to gain unauthorized access to other users' data or the platform's infrastructure.
  9. Intellectual Property

    All site content, design elements, and branding (excluding user content) are property of Speak Africa. You may not copy, distribute, or use them for commercial purposes without written consent.

  10. Limitation of Liability

    Speak Africa is not liable for indirect or consequential damages related to the use of this platform, including loss of data, profit, or product misuse.

  11. Governing Law

    These Terms are governed by the laws of Nigeria. Disputes shall be resolved through mediation or arbitration where applicable.
